2023 Legislative Status

1. Insurance Reform HB1527 PASSED - time limits for insurance companies to request refunds (retroactive denials). Signed into law effective September 1, 2023. 

2. Hygiene local anesthesia - HB3824 – PASSED -Effective September 1, 2023.  This is now an agreed upon bill by most dental associations and anesthesiologists.  

 3. HB1570 - changes to dental board sunset from September 2029 to September 2033  (positive change for TSBDE) - DEAD

4. Clear Aligners - SB384  DEAD- requires comp exam by dentist prior to sale of aligners.  Started as senate bill & now in the house. House Public Health Chariman refused to set it for public hearing. 

5. Increases in Medicaid dental reimbursements FAILED- last increase was in 2007 resulting in many leaving Medicaid due to low reimbursement.  Charge is led by TDA & supported by the vast # of dentists.  We have upwards of 45B$ to spend if so chosen (budget, rainy day fund, etc.).  There is general reluctance to raise medicaid rates. 

6. HB4369 Texas version of the new DEA CE requirement- DEAD.  The new requirement did not pass.  

7. HB3770 Mandates Board tracks CE for DHP-  DEAD

8. HB3942 Teledentistry insurance coverage- DEAD – Failed to pass in Senate 

9. SB1178/HB3524 General anesthesia for pediatric dentisty insurance coverage- DEAD Puts the GA for dental treatment for children up to age 13 to be covered by medical insurance part of your health plan (instead of dental add on insurance packages. 

10. HB3039 Dentist/Dental hygienist interstate licensure compact - DEAD.  

11. HB1930 CRNA administration anesthesia for dentists without same level permit - DEAD 

12. HB4562 Eliminates DSO reporting to Board - DEAD

NEW TSBDE RULE

108.7 - for anxiolysis, these medications can be prescribed without a sedation permit

            ***Halcion is NOT an anxiolytic, but a sedative at all levels of administration

                        -“Should” be administered in office

-  Must have at least a Level 1 sedation permit in order to prescribe or administer  Halcion
