Effective September 1, 2023, The Texas Medical Disclosure Panel (TMDP) enforced amendments to the “Disclosure and Consent -Anesthesia and/or Perioperative Pain Management Form”. The amendments include an informed consent form to disclose risks of anesthesia provided by healthcare providers to their patients.
Dentists are not required to use this form; however, if an event transpires during treatment and there is no proof that the dentist informed the patient of the TMDP outlined risks, the dentist may be found negligent in informing the patient of the risks. While the TMDP consent form may be advantageous in civil litigation, it does not replace TSBDE requirements for informed consent for sedation/anesthesia.
In addition, you will want to review the portion of the amendments related to risks of the dental treatment.

It is each doctor or practice’s responsibility to determine how best to incorporate this new consent into their informed consent process AS WELL AS how to incorporate the dental treatment risks into their consent forms.

Dr. Sara Bender took over as president of TSP on January 28, 2023 after presenting Dr. Matt Steffer with a plaque of thanks for his years of service. Dr. Bender earned a Bachelor of Arts from Austin College in Sherman, Texas. She furthered her education at The University of Texas Health Science Center in San Antonio where she was Valedict

Dr. Bender earned a Bachelor of Arts from Austin College in Sherman, Texas. She furthered her education at The University of Texas Health Science Center in San Antonio where she was Valedictorian of her dental class and received her Doctorate of Dental Surgery. She continued her education at the Health Science Center in San Antonio to earn her Certificate in Periodontics and a Masters of Science in Biomedical Sciences. Dr. Bender is a Diplomate of the American Board of Periodontology.
Amy Purifoy Lopez has been named as TSP’s new executive director. Amy has worked in the periodontal field in Fort Worth for over 25 years. She brings a knowledge of the TSP and the TSBDE to the table.
